The whole point of the ICC is to enforce international law when local governments refuse to prosecute war crimes. My memory is that the ICC only has jurisdiction when lawless countries like Israel or Russia won't prosecute criminals like Putin or Netanyahu.

State actors who commit war crimes will always try to avoid accountability by legalistic arguments. But there is jurisdiction over Israel because it is committing war crimes in Palestine which ratified the treaty.

Israel is NOT a democracy, it is an apartheid State. You can't be a democracy and deny full right to Palestinians, Armenians, Druze, etc. The law in Israel discriminates in favor of one ethnic group.
