"South Dakota’s governor and attorney general today backed down from their unconstitutional attempts to silence pipeline protestors. In response to a lawsuit we filed alongside the ACLU of South Dakota and the Robins Kaplan law firm, the state has agreed to never enforce the unconstitutional provisions of several state laws that threatened activists who encourage or organize protests, particularly protests of the #KeystoneXL [#KXL] pipeline, with fines and criminal penalties of up to 25 years in prison.
"The settlement agreement reached today and now headed to the court for approval is an important victory for the right to protest. It comes soon after a federal court temporarily blocked enforcement of the pieces of the laws that infringed on First Amendment protected speech, and makes the court’s temporary block a permanent one.
"The laws include the #RiotBoostingAct, which gave the state the authority to sue individuals and #organizations for 'riot boosting,' a novel and confusing term. The court warned against the laws’ broad reach, noting that the laws could have prohibited:
- Sending a supporting email or a letter to the editor in support of a protest
- Giving a cup of coffee or thumbs up or $10 to protesters
- Holding up a sign in protest on a street corner
- Asking someone to protest
"Under the First Amendment, that is impermissible.
"The court rightly recognized the stakes of this case. And it put these #AntiProtest efforts in perspective, asking 'if these riot boosting statutes were applied to the protests that took place in Birmingham, Alabama, what might be the result?' The answer: 'Dr. King and the Southern Christian Leadership Conference could have been liable under an identical riot boosting law[.]'
"Indeed, South Dakota’s unconstitutional anti-protest efforts echoed the suppression of past social movements. From the start, South Dakota Governor Kristi Noem called on 'shut[ting] down' 'out-of-state people' who come into South Dakota to 'slow and stop construction' of the pipeline. Her harmful calls were reminiscent of government attempts throughout our history to delegitimize and minimize significant #SocialMovements as the work of 'outside agitators,' including Reverend #MartinLutherKingJr.
"South Dakota’s quick and costly retreat (they’ll have to compensate plaintiffs for attorney’s fees under the settlement agreement) should serve as a lesson for other legislatures considering similar efforts to silence dissent.
"In the last few years, we have witnessed a legislative trend of states seeking to criminalize protest, deter political participation, and curtail freedom of association. These bills appear to be a direct reaction from politicians and corporations to some of the most effective tactics of those speaking out today, including water protectors challenging pipeline construction, Black Lives Matter, and those calling for boycotts of Israel. These legislative moves are aimed at suppressing dissent and undercutting marginalized and over-policed groups voicing concerns that disrupt current power dynamics.
"But the First Amendment guarantees people the right to voice their opposition. This includes our clients — four organizations (the #SierraClub, #NDNCollective, #DakotaRuralAction, and the #IndigenousEnvironmentalNetwork - #IEN) and two individuals (#NickTilsen with NDN Collective and #DallasGoldtooth with Indigenous Environmental Network) — all of whom are protesting construction of the Keystone XL pipeline and encouraging others to do the same.

"Some Native American tribes say tribal members are being harassed by federal immigration agents, while others fear they could be wrongly caught up in immigration raids.
Why it matters: The angst among some #Indigenous tribes reflects the confusion and fear even among legal citizens during the #Trump administration's immigration raids.
The big picture: Several tribes have issued warnings and advice to their members based on what they say have been encounters in which U.S. immigration agents have demanded proof of citizenship — episodes that the tribes have linked to #RacialProfiling.
The alarm comes as Immigration and Customs Enforcement (ICE) says its agents are arresting more than 1,000 undocumented immigrants a day, part of President Trump's push to deport "millions" of people not authorized to stay in the U.S.
Immigration raids in cities such as Chicago and Los Angeles — and Trump's new directives to allow searches in schools and churches in addition to workplaces and homes — have heightened concerns in communities across the country.
Zoom in: The #NavajoNation, one of the nation's largest tribes, said federal immigration agents have been questioning its members.
"My office has received multiple reports from Navajo citizens that they have had negative, and sometimes traumatizing, experiences with federal agents targeting undocumented immigrants," Navajo President #BuuNygren said in a statement.
Navajo Nation officials told CNN on Monday that at least 15 Indigenous people in the southwestern U.S. have reported being questioned or detained by immigration officers in the past week.
The 17.5 million-acre Navajo Nation is in northeastern Arizona, northwestern New Mexico, and southeastern Utah. It's larger than 10 states.
ICE offices in Utah and Washington, D.C., did not immediately respond to Axios' requests for comment.
Zoom out: The #MescaleroApache Tribe in New Mexico announced that a member was confronted by ICE agents last week and was asked for ID — first in Spanish, although the member spoke English.
The #SissetonWahpetonOyate of the Lake Traverse Reservation in South Dakota said it was temporarily waiving all fees for issuing or replacing tribal IDs amid members' concerns about ICE encounters.
#Ute Indian Tribe Business Committee — the tribe's governing body — promised in a statement Saturday to "aggressively defend our rights and interests."
The tribe offered legal counsel to members who are "improperly detained or questioned," as did the Paiute Indian Tribe of Utah.
The San Juan Southern #Paiute Tribe, whose land crosses the Utah-Arizona border, advised its citizens to record encounters with ICE, ask for agents' badges and keep their doors closed and ask for a warrant if approached at home.
What they're saying: Trump's immigration executive orders have "raised concern among our tribal members, particularly regarding the potential targeting of our community by immigration agents," #ChippewaCree Tribe chairman Harat BaRete said in a statement.
The north-central Montana tribe then released a set of guidelines urging members to remain silent, keep ID handy and report encounters to tribal officials.
"The #RosebudSioux Tribe is in the process of assessing the legal effects of the unlawful and unconstitutional Trump administration Executive Orders and will fiercely defend against any threat to the sovereignty," the South Dakota tribe said in a statement.
Between the lines: It's not unusual for ICE or DEA agents to enter tribal lands for immigration or drug enforcement.
Since the Obama administration, U.S. agents have aggressively targeted human smuggling rings that use isolated Indigenous lands to try to move undetected.
Congress didn't grant citizenship to Native Americans until 1924 — a development President Trump's lawyers cited in their attempt to justify his temporarily blocked executive order to overturn birthright citizenship.
The administration's attorneys last week invoked an 1884 U.S. Supreme Court ruling that denied citizenship to members of tribes to argue that "birth in the United States does not by itself entitle a person to citizenship."
Some tribal leaders saw the argument as a threat against their members' U.S. citizenship."

"A South Dakota tribe has banned Republican Gov. Kristi Noem from the #PineRidgeReservation after she spoke this week about wanting to send #RazorWire and security personnel to #Texas to help deter immigration at the U.S.-Mexico border and also said cartels are infiltrating the state’s reservations.
“'Due to the safety of the #Oyate, effective immediately, you are hereby Banished from the homelands of the #OglalaSioux Tribe!” Tribe President #FrankStarComesOut said in a Friday statement addressed to Noem. “Oyate” is a word for people or nation.
"#StarComesOut accused Noem of trying to use the border issue to help get former U.S. President Donald Trump re-elected and boost her chances of becoming his running mate.
"Many of those arriving at the U.S.-Mexico border are #IndigenousPeople from places like #ElSalvador, #Guatemala and #Mexico who come 'in search of jobs and a better life,' the tribal leader added.
"'They don’t need to be put in cages, separated from their children like during the Trump Administration, or be cut up by razor wire furnished by, of all places, South Dakota,' he said.
"Star Comes Out also addressed #Noem’s remarks in the speech to lawmakers Wednesday in which she said a gang calling itself the Ghost Dancers is murdering people on the Pine Ridge Reservation and is affiliated with border-crossing cartels that use South Dakota reservations to spread drugs throughout the Midwest.
"Star Comes Out said he took deep offense at her reference, saying the #GhostDance is one of the Oglala Sioux’s “most sacred ceremonies,' 'was used with blatant disrespect and is insulting to our Oyate.'"

"A new South Dakota policy to stop the use of gender pronouns by public university faculty and staff in official correspondence is also keeping #NativeAmerican employees from listing their tribal affiliations in a state with a long and violent history of conflict with tribes.
"Two University of South Dakota faculty members, Megan Red Shirt-Shaw and her husband, John Little, have long included their gender pronouns and tribal affiliations in their work email signature blocks. But both received written warnings from the university in March that doing so violated a policy adopted in December by the South Dakota Board of Regents.

"House Republicans are trying to push through a bill that would give President-Elect #DonaldTrump powers as president to designate #nonprofit organizations as '#TerroristSupporting' even after it was seemingly defeated earlier this week.
"The Stop Terror-Financing and Tax Penalties on American Hostages Act #HR9495 would allow the secretary of the treasury the ability to revoke any nonprofit organization’s tax-exempt status by branding it with a terrorism label. Earlier this week, the bill failed to receive the necessary two-thirds majority in the House to advance to the Senate.
"But on Monday, the House Rules Committee plans to hold a hearing that could set up a new vote on the bill, which initially had the support of all but one Republican and 52 Democrats. With the GOP only holding a seven seat majority in the chamber, they would need the support of more Democrats to advance the bill, which was introduced to combat #protests against #Israel’s war on #Gaza.
"Under any circumstances, the bill would threaten #FirstAmendment rights to #FreeSpeech, but after Trump’s election last week, there are now fears that the president-elect could use these new powers to crack down on his enemies with little recourse. Many #universities and #NewsOutlets are nonprofit organizations in addition to #activist groups.
"After the bill’s initial failure on Tuesday, the American Civil Liberties Union [#ACLU] celebrated the rejection of 'new broad and easily abused powers.'
"'The freedom to #dissent without fear of government retribution is a vital part of any well-functioning democracy, and now is not the time to grant the executive branch new powers to investigate and functionally shut down and silence its critics,' said Kia Hamadanchy, senior policy counsel for the ACLU, in a statement.
"Now, the bill could be given a retooling and sent up for a vote again, giving a president who has already threatened to use the #military against his critics even more sweeping powers. The question is if #Democrats will recognize the bill as granting dangerous powers to the presidency, or see it as a chance to clamp down on protesters they have tried to ignore at their peril for the past year.'"
