Universal Music, Sony Music Entertainment, Capitol, and other record labels filed a copyright lawsuit on Friday against Internet Archive, founder Brewster Kahle, and others over the organization’s “Great 78 Project,” accusing them of behaving as an “illegal record store.” The suit lists 2,749 pre-1972 musical works available via Internet Archive by late artists, including Frank Sinatra, Ella Fitzgerald, Chuck Berry, Billie Holiday, Louis Armstrong, and Bing Crosby, among others. https://www.rollingstone.com/music/music-news/record-labels-sue-internet-archive-412-million-copyright-infringement-lawsuit-1234806058/ #copyright #music #internetarchive #libraries
Only one thing to say about this is, greed personified, sure I agree that the site may have operated quite dodgily, but these artists are beyond benefiting from any result, so what is the real motivation here, imho it is record label greed.
The first instance judgment in favour of publishers vs the internet archive has no doubt emboldened other copyright owners to bring action as well.
Long copyright duration is a big issue for libraries, archives, etc.
Statement from Brewster Kahle, digital librarian of the Internet Archive:
“When people want to listen to music they go to Spotify. When people want to study 78rpm sound recordings as they were originally created, they go to libraries like the Internet Archive. Both are needed. There shouldn’t be conflict here.” https://blog.archive.org/2023/08/14/internet-archive-responds-to-recording-industry-lawsuit-targeting-obsolete-media/ #copyright #music #internetarchive #libraries

In Friday’s complaint, the music companies cited the Internet Archive’s “long history of opposing copyright laws” and previous efforts to “improperly … wrap its infringing conduct in the ill-fitting mantle of fair use.”

“Having failed repeatedly in Congress and the courts, Internet Archive now chooses to simply willfully disobey the copyright laws of which it is acutely aware,” lawyers for the music companies wrote. #copyright #music #internetarchive #libraries
