"As readers of this newsletter know, I think people are mature enough to handle difficult truths. That’s why I’ve published documents other outlets refused to, from the JD Vance Dossier to the Luigi Mangione manifesto. I was vilified for facilitating copycat murders that never materialized, foreign influence operations that didn’t work (Vance is now Vice President), and for being generally “irresponsible.”

To me, what’s irresponsible is the national security state’s gradual creep into civic life — including, apparently, journalism. Obvious as that seems, I’ve paid a personal price for acting on my belief that my primary duty as a journalist is to inform the public. I’m never going to appear in a top White House official’s contacts list like Goldberg did, or score an exclusive interview with one of them or an invite to a black tie event. So I get why people like Goldberg do what they do. But we shouldn’t pretend it’s about protecting our national security.

Here’s what happens whenever a leak not authorized by the government hits the desk of some national security auxiliary. The normal standard for publication — is it newsworthy? — goes out the window as the reporter or their outlet scrambles to find out how the story might affect their own interests. Would publication piss off someone in power or otherwise jeopardize access to officialdom? Could it aid some nefarious actor somewhere? Could it contradict our previous reporting?"

"Shortly after senior Trump administration officials discussed and celebrated the bombing of Yemen in an encrypted group chat that, unbeknownst to them, included the editor-in-chief of the Atlantic, a subset of the group feasted at an opulent, secret dinner featuring the president where guests were asked to pay $1 million apiece to snag a seat.

The date was Saturday, March 15. President Donald Trump was at his Mar-a-Lago estate attending a “candlelight” dinner that wasn’t on his public calendar. On the lawn outside, luxury cars were on display: a Rolls Royce was parked near a Bugatti and Lamborghini. Guests milled about, taking photographs of each other and the vehicles. Earlier that day, the United States had bombed Yemen, targeting Houthi leadership. At least 53 people, including children, were killed.

Trump flew to the event on Air Force One with Elon Musk and Musk’s four year old son X, according to photos and videos viewed by WIRED. Throughout the weekend, Musk was in close contact with Trump and at least one member of the president’s brain trust who was participating in a Signal group chat where highly sensitive details of the planned operation were being shared. Experts say the conversation appears to have violated government protocols on information sharing."

Journalists reporting on data leaks or breaches in Turkey will be at greater risk of prosecution and prison. The Committee to Protect Journalists reports:

"Turkey’s new cybersecurity law could criminalize legitimate reporting on cybersecurity incidents because of its overly broad and vague language, the Committee to Protect Journalists said Thursday.

The law, passed on Wednesday, criminalizes reporting about an online data leak or sharing that report unless the authorities have confirmed the incident.

It imposes a prison sentence of two to five years for anyone who knowingly creates or spreads “false” content claiming that there is a cybersecurity data leak “in order to create anxiety, fear, and panic among the public, or to target institutions or individuals."

Here's my post on the court injunction my site got hit with:

HCRG Care's lawyers claimed an injunction issued in a "private" hearing required us to remove two posts. We didn't comply.

HCRG Care was represented by the Pinsent Masons law firm in the UK in this matter. The injunction was issued by the High Court of Justice, King's Bench Division, Media and Communications List by the Honorable Mr. Justice Soole.

Pinsent Mason's attempt to get my web host to remove my posts also failed.

As always, I feel blessed to have the legal support of Covington and Burling's Kurt Wimmer Pro Media Freedom Initiative, which has represented my site pro bono for the last 16 years.

Read about the letter, the injunction, and why the High Court's over-reaching injunction endangers UK journalists and doesn't serve the public well.

Oh, and I'm not the only one ignoring the injunction. Medusa also got served with the injunction via tox chat, they tell me. And like other injunctions they have received, they are ignoring it. So what has HCRG really accomplished?

A quotation from Arendt
The moment we no longer have a free press, anything can happen. What makes it possible for a totalitarian or any other dictatorship to rule is that people are not informed; how can you have an opinion if you are not informed?

Ukrainian journalist Victoria Roshchyna, who was captured by Russian forces in the summer of 2023, endured brutal torture in captivity, according to an investigation by Slidstvo.Info. Investigators found she suffered knife wounds, electric shocks, and became so emaciated her weight dropped to just 30 kilograms. Russian prison staff reportedly hid her from inspections to conceal her deteriorating condition.

"The United States is not Russia by any means, and any comparisons risk going too far. Russia barely had any history with democracy then, while American institutions have endured for nearly 250 years. But for those of us who reported there a quarter century ago, Mr. Trump’s Washington is bringing back memories of Mr. Putin’s Moscow in the early days.

The news media is being pressured. Lawmakers have been tamed. Career officials deemed disloyal are being fired. Prosecutors named by a president who promised “retribution” are targeting perceived adversaries and dropping cases against allies or others who do his bidding. Billionaire tycoons who once considered themselves masters of the universe are prostrating themselves before him.

Judges who temporarily block administration decisions that they believe may be illegal are being threatened with impeachment. The uniformed military, which resisted being used as a political instrument in Mr. Trump’s first term, has now been purged of its highest-ranking officers and lawyers. And a president who calls himself “the king,” ostensibly in jest, is teasing that he may try to stay in power beyond the limits of the Constitution."

"The three permanent wires in the White House pool, The Associated Press, Bloomberg News and Reuters, have long worked to ensure that accurate, fair and timely information about the presidency is communicated to a broad audience of all political persuasions, both in the United States and globally. Much of the White House coverage people see in their local news outlets, wherever they are in the world, comes from the wires.

It is essential in a democracy for the public to have access to news about their government from an independent, free press. We believe that any steps by the government to limit the number of wire services with access to the President threatens that principle. It also harms the spread of reliable information to people, communities, businesses and global financial markets that heavily depend on our reporting."

For an administration that lectures the world, Europe in particular, about democracy and free speech, it is rather stunning what is done to stiffle free press.

Press freedom is already low in the US (ranked 55). The administration works hard to reduce freedom further

" ‘A true free-speech emergency’: alarm over Trump’s ‘chilling’ attacks on media"

"Warning comes as FCC, chaired by Trump ally and Project 2025 author, orders investigations into US media groups"

#USpol #USpolitics #FirstAmendment #pressfreedom #media #journalism

https://www.theguardian.com/us-news/2025/feb/24/trump-free-speech-media-attack
Rebecca Hamilton, a professor at American University Washington College of Law, told the Guardian that the FCC investigations could affect journalists’ ability to report on the Trump administration.

“Valid FCC investigations can have a positive impact on the information ecosystem. But the latest FCC investigations launched by Carr are aligned with a broader effort by the Trump administration to punish outlets that Trump dislikes. Such investigations risk creating a chilling effect on the ability of journalists to report without fear of retaliation,” she said.

The FCC's investigations into media organizations, Hamilton wrote in a recent piece for Just Security, represent “a wholesale effort by Trump and his allies to eviscerate the free press in order to construct an information ecosystem dominated and controlled by those who espouse his views".

"Let me make clear that the lawsuit is a bunch of nonsense. Trump’s legal theory doesn’t exist anywhere in the law, and so not only is the settlement bad in terms of putting the onus on everyone else to settle, but the entire premise of the lawsuit is ridiculous. News outlets are allowed to edit interviews! Hard to believe it even has to be said.
(...)
The suit is from Mars. To my knowledge, I’ve never seen a suit brought like this one where editing is being criticized as constituting consumer fraud. It has no basis in law as far as I’m concerned, and what’s going to happen — if, in fact, the case is settled — is there will be more consumer fraud cases every time the media edits an interview, not only with Trump, but other politicians. And the First Amendment will suffer."

#Haaretz / A case study in how democracy crumbles, self mutilates and surrenders to populism (in broad daylight)

Haaretz published yesterday an opinion piece by David Schocken, a potential heir to the liberal newspaper Haaretz, in which he argues that the (low circulation though profitable and influential) newspaper has become too insular, ideologically homogenous, and fearful of dissenting opinions. He implies that the paper should be more open to a wider range of viewpoints, including those from the right-wing.

Succession 👑 and sugar-coated facade of pluralism

Shuki Tausig, The Seventh Eye’s editor, strongly supports Haaretz’s stance. In order to protect democratic values, a "defensive democracy" approach dictates that certain views should not be given a platform. To David Schoken’s claim that the paper is alienating people on the right he simply states: why should the paper cater to the right? It's a left-leaning paper.

[…] An important article is published in the opinion pages of "Haaretz." Not because of its content, which is foolish and irresponsible, certainly not because of its pompous tone, and definitely not because of the embarrassing ignorance and cowardice it's bursting with, but because of the author's identity: David Schocken. He is one of two possible heirs to the position of publisher of Haaretz, alongside his cousin, Roni Schocken.

[…] David Schocken writes that "there are some people in the newspaper who are proud of excluding writers with 'dangerous' opinions that, in a 'defensive democracy,' shouldn't be legitimized." Just like countless cheap manipulators before him, David Schocken won't lie, he'll just put quotation marks around the truth.

[…] David, dangerous opinions aren't 'dangerous' opinions. They are dangerous opinions. A defensive democracy isn't a '"defensive democracy." It's a defensive democracy. If David Schocken thinks there are no dangerous opinions and that our democracy doesn't need defending, he should grow a pair and write it. Instead, he resorts to the villain's other escape route. Not patriotism - quote marks."

The rhinoceros 🦏 in the room

Aluf Benn, Haaretz’s current editor-in-chief chimed in arguing that Haaretz must remain committed to its core values, particularly human and civil rights, even in the face of political pressure and attempts to silence the paper. He emphasizes that the paper's role is to challenge the government and speak truth to power, even when that means going against popular opinion. He implicitly accuses Schocken of being naive and prioritizing the paper's financial interests over its journalistic integrity.

[…] On my desk at the Haaretz newsroom sits a small plastic rhinoceros. I put it there after the last elections, a reminder that the newspaper must never compromise its values and principles just to run with the herd. I knew from the very beginning that during the reign of this government of horrors, we would face pressures and temptations to abandon the newspaper's long-standing commitment to defending human and civil rights, to shut up and join some imaginary, cozy center. In moments like these, I thought, we'd need to look at the rhino as a warning sign.

[…] The rejection of these articles wasn't meant to protect "Haaretz" readers from "consuming poisonous opinions," as Schocken puts it. Readers are already bombarded with these views from every screen, news page, and tweet, and, of course, they're also reported on in Haaretz. The rejection was intended to draw a line in the sand, to mark the boundaries of acceptable opinions that the newspaper will provide a platform for. Just as we haven't published articles supporting the dismantling of the judiciary's independence and turning it into a puppet of the Likud party, even though that position also enjoys broad public support.

[…] David Schocken apparently believes that if we "rhino-fy" ourselves and open the newspaper up to debates on "transfer, pro and con," or to proposals on how to persuade and relocate Gazans, we'll be giving readers intellectual enrichment and a "fierce and wild ideological battle," and in doing so, we'll attract new subscribers and lift the government's boycott."
