Two lawsuits could provide further insight into DOGE

On Wednesday, US District Judge Tanya Chutkan ordered Musk and his DOGE collaborators to provide records and testimony about its plans to slash federal agencies. The order seeks to establish the “parameters of DOGE’s and Musk’s authority.” From Politico:

"[Chutkan’s order] is a win for a group of 14 Democratic state attorneys general who are suing President Donald Trump, Musk and DOGE, arguing that Musk has unconstitutionally wielded immense power in ways that are damaging their states. Any information the states glean as a result of Chutkan’s decision will help her determine whether to block Musk and DOGE’s government activities altogether. It’s the first time a judge has ordered Musk to produce documents in a court challenge to his aggressive campaign to slash and reshape the federal bureaucracy."

Musk and DOGE have three weeks to fulfill the discovery requests.

Judge John Bates ruled last week that a member of DOGE must testify in a case challenging the group’s access at the Consumer Financial Protection Bureau and the Departments of Labor and Health and Human Services. A federal judge of the U.S. District Court for the District of Columbia, Bates said the deposition would be “necessary to determine the contours of the agency actions that plaintiffs challenge.” Musk has repeatedly called for Bates to be impeached, describing him as an “evil judge.” Andy Ogles, a House Republican from Tennessee, heeded Musk’s request, introducing articles of impeachment last month against Bates, whom he described as a “radical LGBTQ activist.”

On Monday, the Justice Department told a federal judge overseeing a lawsuit challenging Musk’s power that he “is not an employee in the U.S. DOGE Service or… the U.S. DOGE Service Administrator.” The lawsuit, filed by a group of Democratic attorneys general, argued Musk’s role in the government violated the Constitution’s Appointments Clause, which grants Congress the power to approve executive branch officers.

Two days later, Trump contradicted his own Justice Department. “I signed an order creating the Department of Government Efficiency and put a man named Elon Musk in charge,” he said at a Miami gathering of Saudi financiers on Wednesday. With Musk in the crowd, Trump added, “Thank you, Elon, for doing it. And he’s doing a great job.” Musk, meanwhile, has claimed personal responsibility for DOGE's work, including canceling federal contracts, instituting mass layoffs, and eliminating federal agencies.

What Is the Privacy Act?

The Privacy Act is a law that limits how the federal government can collect, use, and share information about US citizens and other people in the United States.

The law’s core features include letting people access government records about them; letting people correct those records if they contain mistakes; requiring agencies to limit information collection, publish lists of records databases, and protect data from hackers; and restricting how agency employees and third parties can access records.

Those restrictions on accessing data are at the heart of the ongoing DOGE saga.
